GENERAL RENTAL CONDITIONS

 

  1. DEFINITIONS

The company: Hollings Group S.L will be referred to hereinafter as “the company” in the General Rental and Insurance Conditions below.

Vehicle groups: All vehicles owned by the company are classified by groups. To identify these groups, they are assigned a number from 1 to 3.

Categories: All vehicle groups have a category assigned to them. These categories range from Category 1 to Category 3. Each category has a range of amounts assigned to establish the deposit, insurance, excess, and additional charges, services or extras.

 

Category 1: Fiat 500 Cabrio.

Category 2: Mercedes Benz Clase A AMG, BMW Serie 1 paquete M, Mini One Cabrio.

Category 3: JEEP WRANGLER or WRANGLER RUBICON.

 

Excess: it is the maximum amount that the lessee will have to pay for the cost of the damage caused to the vehicle. The Excess is an amount that is covered by contracting the Premium insurance.

 

Deposit: is the amount that the tenant pays in cash or the amount that will be charged to his credit card. It is aimed at covering the additional expenses derived from the rental. In the case of depositing the amount in cash, it will be returned at the end of the contract once the vehicle has been reviewed.

 

  1. ESSENTIAL REQUIREMENTS

2.1. MINIMUM AGE AND EXPERIENCE

21 years and 2 years of experience (with a supplement for drivers under 23 years of age) for Category 1.

23 years and 3 years of experience for Category 2.

30 years and 7 years of experience for Category 3.

 

2.2. REQUIRED

Valid passport/DNI and valid driving license when picking up the vehicle.

Valid driving license to drive in Spain.

 

Driving licenses from the following countries:

European Union countries.

Countries of the European Economic Area: Iceland, Liechtenstein and Norway.

In addition, the following permissions are valid:

Annex 9 of the Geneva Convention and Annex 6 of the Vienna Convention.

Version of the Annexes in Spanish – Version of the Annexes in English.

National permits from other countries that are written in Spanish or are accompanied by an official translation of the same are also admitted.

International driving licenses.

 

  1. PAYMENT METHODS

3.1. FOR ONLINE RESERVATIONS

Our online reservation system accepts payment with:

VISA cards

MASTERCARD cards

AMERICAN EXPRESS cards

PAYPAL

ATTENTION: if you make the payment with an AMERICAN EXPRESS or PAYPAL card, a surcharge of 5% of the total payment will be applied.

 

3.2. AT OFFICE OR RESERVATION CENTRAL

The offices accept payment with:

Cash (in euros)

VISA cards

MASTERCARD cards

AMERICAN EXPRESS cards

ATTENTION: If you make the payment with an AMERICAN EXPRESS card, a surcharge of 5% of the total payment will be applied.

 

3.3. WARRANTY

A credit card is needed as a guarantee to cover the expenses derived from the contract, also understanding all the expenses incurred after the termination of the rental contract. Like those referenced in point 6.11.

Payment card information (ie card number and validity date) is subject to archiving for a period of 12 months from actual payment for a credit card. It can be kept for a longer period of time, always with your express consent to facilitate future payments. In any case, when the payment card expires, the related information will be deleted.

The holder of the credit card number must be included as a driver in the Rental Agreement, as explained in point 5.1.

 

  1. RESERVATION INFORMATION

4.1. ONLINE RESERVATIONS

The web pages owned by the company, associated web pages and associated booking engines only allow reservations to be made at least 24 hours before delivery of the vehicle. Therefore, it is not possible to book less than 24 hours in advance.

If the client makes a reservation more than 24 hours in advance, but tells us that he needs the vehicle to be delivered less than 24 hours, the procedure will be as per section 5.

The discounts offered on the website or online booking engines only apply to reservations made on the websites owned by the company. Not being applicable for reservations made at the Reservation Center, offices or on associated web pages.

The discounts only apply to the amount of the vehicle rental, not to the extras.

These discounts may be modified in advance and amount, delete and all without prior notice.

The rental amounts for the vehicles offered on the websites owned by the company may change over time, depending on the availability of vehicles, the supply and demand for them, and all without prior notice.

The amount of a reservation already made will never be subject to modifications. The total amount of the reservation will be the one that is reflected in the confirmation of the same.

 

4.2. RESERVED VEHICLE GUARANTEE

The company guarantees the reserved model in all cases. If due to force majeure the reserved group or model cannot be served, alternatives of a higher group will be offered, at no additional cost to the client.

 

4.3. RESERVATION CANCELLATIONS

4.3.1. WITH MORE THAN 48H IN ADVANCE

-If the cancellation is made more than 48 hours before the date and time scheduled in the reservation, a voucher will be issued for the total amount of the same or a refund of the amount paid, according to the client’s choice.

 

4.3.2. WITH LESS THAN 48H IN ADVANCE

-If the cancellation is made less than 48 hours before the date and time scheduled in the reservation, the entire amount paid is lost, regardless of the reason for the cancellation.

 

IMPORTANT: The cancellation of a reservation must be requested in writing to the email info@rent4experience.com; this being the only valid means.

 

If the client wants to cancel the Rental Agreement without having reached its final duration, the company is not obliged to return the amount for the remaining time until the end of the rental.

 

4.4. RESERVATION MODIFICATIONS

The modification of any data of the reservation entails a management fee of €12.

The amount of a reservation already made will never be subject to modifications. If due to a modification the rental price increases, the client must pay the difference in price plus management fees.

 

IMPORTANT: the modification of a reservation must be requested in writing to the email info@rent4experience.com; this being the only valid means.

 

4.5. CUSTOMER ERRORS WHEN MAKING A RESERVATION

The company will not be responsible for refunding any amount if the client erroneously enters the data in the reservation, such as delivery and/or return point, delivery and/or return dates, reserved vehicle group, extras…

The company reserves the right to modify reservations with data entered erroneously. Being able to modify them whenever there is availability of the vehicle and/or extras.

These types of modifications will be according to point 4.4.

The client may also cancel the reservation, according to the conditions in point 4.3.

 

  1. CLAUSES OF THE RENTAL AGREEMENT

5.1. PREAMBLE

The General Conditions of the rental will be applicable to the person who signs the Rental Agreement and who presents, as a deposit for the vehicle, the corresponding credit card of which they are the holder or an amount in cash (to be determined according to the contracted model). All the costs associated with the Rental Agreement will be assumed by the person who signs it (regardless of whether he appears as the driver of the rented vehicle) as well as any other driver expressly indicated in the Rental Agreement, and therefore authorized to drive the vehicle.

All persons identified in the Rental Agreement will be jointly and severally liable for the payment of any amount due under the agreement.

In the event that the reservation had been made and prepaid by a person other than the main driver, said person must appear in the rental contract as an additional driver, in order to prove the legal relationship of the same with the company.

 

5.2. VEHICLE

The lessee receives the vehicle specified in the Rental Agreement in perfect working order, with all the necessary documents, tires, tools and accessories, as well as in good general exterior and clean condition. The lessee is responsible for damages caused to the vehicle (which are not specified in the check sheet that is delivered together with the Rental Agreement), as well as its theft or loss.

 

Likewise, it undertakes to:

  1. Preserve with the utmost diligence the good general condition of the vehicle without carrying out in any case fraudulent manipulation of any element of it.
  2. Respect at all times and places the regulations of the Traffic Code in force, as well as any legal provisions regarding circulation, transport and Road Safety.
  3. Do not allow the vehicle to be driven by persons not authorized in this contract.
  4. Do not transport people or goods when this explicitly or implicitly implies the subletting of the vehicle or non-compliance with legal provisions regarding weight, height, quantity, volume and nature of the load.
  5. Do not drive the vehicle outside the island of Ibiza (not even in Formentera), unless express prior authorization in writing from the company
  6. Do not drive in inferior physical and/or mental conditions motivated by the use of alcohol, drugs or narcotic substances, as well as by fatigue or debilitating illness.

In the event that at the time of collecting the vehicle the employee suspects that the client has inferior physical and/or mental conditions due to the use of alcohol, drugs or narcotic substances, the company reserves the right not to deliver reserved vehicle and that the client does not receive any compensation.

  1. Do not use the vehicle to push or tow other vehicles, or participate in races, contests or competitions of any nature.
  2. Do not drive on unpaved roads or roads not suitable for circulation that may cause damage or damage to the lower part of the body.
  3. Be in possession of the corresponding driving license, in force and with the seniority and minimum age in accordance with point 2.1. Hollings Group S.L reserves the right of admission in any case.
  4. Close the vehicle, park in a suitable, adequate, safe place and with the handbrake activated when it is not being used.
  5. Use the mandatory restraint devices for the transport of people with a height equal to or less than 135 cm. The company will in no case proceed to the installation and/or placement of the aforementioned security device.
  6. Do not act negligently, this being understood as the lack of care, application and diligence, especially in the fulfillment of keeping, protecting and ensuring the good condition of the vehicle.

Failure to comply with any of the aforementioned obligations written in this clause may limit or cancel the contracted coverage, and the company may require the lessee to pay all the damages suffered by the vehicle (see General Insurance Conditions).

The limit of the maximum amount of money, Excess, that the lessee will have to pay for the cost of the damage caused to the vehicle will also be annulled.

 

In case of gross negligence on the part of the client, the company reserves the right to terminate the contract and immobilize or requisition the vehicle

 

5.3. INSURANCE AND PROTECTION

See the General Conditions of Insurance attached to this document.

 

5.4. REPAIRS

The lessee will inform the company of any breakdown suffered by the vehicle. The company will not be responsible for the amount of the repair carried out by people who lack express written authorization, nor is it responsible for any agreement between the lessee and a person outside the company. In the event of a breakdown, the company, for technical reasons, needs a minimum time to solve the problem, which is estimated at 4 hours from the time it becomes known.

The lessee must go to a company office to check fluid levels every 1000 km and replace them if necessary.

 

5.5. ACCIDENTS

The lessee undertakes to urgently report any loss to the company and to immediately transmit as many notifications that refer to said loss, and to provide full cooperation to the lessor and the insurance company in the investigation and defense of any claim and process. In the event of an accident or loss, the lessee undertakes to:

Failure to recognize or prejudge responsibility for the act.

Obtain complete data from the opposing party and all the circumstances surrounding the accident, duly completing the friendly accident report. In case of not completing the friendly part, an extra charge of €90 will be made.

Immediately notify the Authorities if the opposing party is guilty.

Go to the nearest office with the damaged car within a maximum period of 4 hours to prepare the corresponding report.

Do not leave the vehicle until the arrival of the Authorities (Police or Civil Guard) or a representative of the company.

In the event of major damage, photos of the incident and as many elements as may be necessary for its clarification will be provided. Major damages are understood to be those that exceed 3 cm in length and/or width; Except for perforations in the sheet metal or exterior elements, which will always be considered as major damage.

In case of non-compliance with the previous points of this section, the lessee will assume all the damages suffered by the vehicle regardless of the insurance coverage contracted.

In the event of an accident or theft of the vehicle, the company is not obliged to replace the leased vehicle.

 

5.6. VEHICLE RETURN

The vehicle will be returned at the place, date and time stipulated in the contract and in the same condition in which it was delivered by the company, with all its documents, tires, tools, keys and accessories. Any alteration in the agreed return conditions may result in additional charges for the lessee. There is a margin of 30 minutes delay in the return with respect to the agreed time; Otherwise, the client will be charged the current rate for the extra days plus a 25% penalty.

 

The calculation of the final amount of the lease will be made once the vehicle has been returned and the penalty established in the previous paragraph has been applied.

If the vehicle is returned before the end of the contracted period, the lessee is not entitled to a refund of any amount on the rate and/or insurance of the contract.

 

5.7. MINIMUM RENTAL PERIOD

It is from any time of the day until 8:00 p.m. on the same day.

 

5.8. CHANGE OF DRIVER

If you want to make a change of driver during the term of the contract, you must go to the nearest office to carry out the corresponding procedure.

Said procedure will imply the resolution of the previous contract and the issuance of a new one. In no case will driver changes be made in the Rental Agreement by phone and/or email. It is absolutely essential to carry out the procedure indicated above in any of our offices.

 

5.9. EXTENSION OF THE RENTAL AGREEMENT

If you want to extend the rental period that appears in the contract, the following steps must be followed:

Go to the nearest office at least 24 hours before the initial termination of the Rental Agreement. The person in charge will verify that the vehicle is available for the new requested dates.

Carry out a check of the vehicle together with an agent of the company.

Pay rent and new additional charges.

Sign a new Rental Agreement or an addendum to the initial agreement.

In the event that you do not proceed in the terms indicated and do not return the vehicle on the agreed date and time, the customer will be charged the current rate for the extra days plus 25% as a penalty.

The company reserves the right to deny the extension request for operational reasons.

 

In no case will extensions be made by phone and/or email. It is absolutely essential to carry out the procedure indicated above in any of our offices.

 

5.10. FUEL POLICY

Full:

The vehicle is delivered to the client with a minimum of fuel and the lessee agrees to return it with the same amount. Otherwise, you will be charged for the missing item plus €18 for refueling costs.

If the vehicle is returned with more fuel than on departure, the customer may claim the remaining amount of fuel, delivering the corresponding refueling ticket/invoice that will remain the property of the company.

In no case will the fuel be returned without the delivery of the aforementioned supporting document.

 

In all cases it is the lessee’s responsibility to refuel the vehicle with the appropriate type of fuel. Any expense or repair (crane, change of filters or other components, vehicle stoppage, fines, etc.) derived from the use of inappropriate fuel will be borne by the lessee.

 

5.11. FINES AND TRAFFIC INFRACTIONS

In the event of a fine, the tenant will be charged the amount of €45 for administrative management expenses. This amount does not include the payment of the penalty. The payment of fines and administrative management expenses is not included in any of the insurance coverage that can be contracted. In the event that the authorities retain the vehicle due to an act or omission on the part of the lessee, whatever the cause, the latter will be responsible and will indemnify Hollings Group for all expenses (towing, retention, penalties…) and lost profits (according to rate in force at that time) incurred for that reason.

 

5.12. EXTRA CHARGES

The lessee expressly authorizes the company to charge the credit card provided for expenses derived from the contract and subsequently send the receipt to the client, in the event of having to pay any amount established and/or derived from the General Conditions of the contract.

 

As per:

The amount pending payment over the previously agreed amount.

Damage caused to the vehicle, even after the contract has been settled, due to having found damage during the process of preparing the vehicle for the next rental.

Additional cleaning derived from the delivery of the vehicle with extreme dirt.

Delay in the delivery of the vehicle or extensions of the Rental Agreement without having respected the procedure established in clause 8

Administrative sanctions.

Administrative management expenses.

Responsibilities for claims.

Any other type of amount derived from negligent action by the lessee.

 

5.13. ADDITIONAL AND EXTRAS SERVICES

The lessee may additionally contract the following services and/or extras:

Baby chair

Child seat

Booster

Out of office delivery

Out of office return

Delivery in villa

Return in villa

Delivery out of hours (Airport and Port Ibiza)

Return out of hours (Airport and Port Ibiza)

Aditional driver

Driver under 23 years

Express return (Ibiza Airport)

MEDIUM insurance

PREMIUM insurance

 

The company, for safety reasons, will not place baby seats or child seats. The customer is responsible for placing the seats in the vehicle.

 

5.14. ROADSIDE ASSISTANCE

Customers who have contracted the “Premium” insurance have the roadside assistance service included in the price. This service will be charged to the lessee in the following cases:

Error, negligence or misuse of the vehicle by the lessee.

Loss of keys, breakage, wetting or abandonment of these inside the closed vehicle.

Lack of fuel or improper refueling.

Rescue of vehicles in places or roads not suitable for driving or not paved.

Depleted battery (in case of negligence of the lessee).

Customers who have not contracted the “Premium” insurance will pay all the expenses incurred (except for faults attributable to the company).

 

5.15. VEHICLE IDENTIFICATION

The lessee must keep the identification stickers and the company key fob in the leased vehicle in order to be identified. The elimination of these elements will entail a surcharge for restitution of €25.

 

5.16. PERSONAL ITEMS

The lessee must empty the vehicle of its personal effects at the end of the Rental Agreement. The company is not responsible for any object left in the vehicle. Without prejudice to this, any object found in the vehicle may be sent to the lessee, with the transport costs being borne by the latter.

 

5.17. PRICES AND RATES

The prices of the contract will be adjusted to the current general rate that is exposed to the general public at the company’s facilities, the content of which the tenant expressly states to know prior to signing the Rental Agreement. All prices are expressed in euros.

 

5.18. SOLIDARITY RESPONSIBILITY

All tenants and/or additional drivers will be jointly and severally liable for all the obligations assumed by the tenant in the contract and for all legislation applicable to it.

 

5.19. CUSTOMER SERVICE AND CLAIMS

5.20. RETURN OF THE DEPOSIT

The deposit will be returned after the vehicle has been examined, which, in the event of damage due to misuse, will determine by means of a detailed note, the amount that the client must pay; authorizing the lessee to compensate said amount of the deposit deposited. If it is not possible to assess the damage immediately, the company will have 30 days to return, where appropriate, the amount of the remaining deposit, once the cost of the repair has been deducted.

 

5.21. DO NOT SHOW UP AT PICK-UP

The non-presentation of the client at the place and time agreed for the start of the service will be considered unilateral termination of the contract and of the reservation by the client, with a penalty of 100% of the contracted rental value. Said non-show will empower the company to dispose of the reserved vehicle, the lessee not having the right to any compensation.

 

5.22. JURISDICTION

Rental contracts are governed by all Spanish legislation that affects you. The parties expressly submit to the arbitration boards of Transport, Courts and Tribunals of Ibiza, for any incidents and issues arising from this contract, except those that deal with matters of Consumption, which will govern the jurisdiction established in its own regulations.

 

5.23. INFORMATION ON PROTECTION AND TREATMENT OF PERSONAL DATA

5.24. TRACKING DEVICES

To conserve and protect the vehicle and to detect and prevent crimes, the company may use electronic devices that allow the status and operation of the vehicle to be monitored and/or its movements to be followed. This information can be used during and after the end of the rental period, with the sole purpose of executing, controlling and complying with this Rental Agreement.

By accepting these General Rental Conditions, the client/lessee expressly declares that they have granted their explicit consent to the use of said electronic devices.

 

5.25. ELECTRIC VEHICLES

It is the customer’s responsibility to maintain the adequate and sufficient charge of the rented electric vehicle battery at all times.

In case of assistance due to discharged battery, the client will assume all the expenses incurred (crane, operator displacement, etc.) and the vehicle will only be replaced if there is availability. Said substitution (if possible) will be carried out in our offices, with an extra charge of €100 for delivery of the vehicle outside of them.

In the event that there are no vehicles available to make the change, the customer will have to wait the necessary time for the complete recharge of the battery. Traveling to our offices is your responsibility and risk.

Upon return of the vehicle, it must have a minimum of 20% battery. Otherwise, a charge of €50 will be made.

  1. ADDITIONAL PROVISION

It is the renter’s responsibility to read this contract carefully. Any doubt or disagreement must be stated before accepting and/or signing the contract.

In case of non-compliance with any of these clauses, the lessee assumes all responsibility for damages that such non-compliance may cause both to the company and to third parties.

 

APPENDIX I: SPECIFIC RENTAL AND INSURANCE CONDITIONS FOR JEEP WRANGLER VEHICLES WITH CANVAS TOP.

 

In cases where a Jeep Wrangler is rented, the General rental and insurance conditions will apply, plus the following specific conditions:

  1. The client must check the hood and structure of the Jeep Wrangler being rented, confirming its perfect state of conservation and operation.
  2. The client is aware and accepts that:

Any damage or loss caused to the hood or its structure, whether accidental or intentional, is not included in any type of insurance; so you must pay in full for its repair or replacement (if it cannot be repaired).

Due to its configuration, it is likely that any damage to the metal structure will require its total replacement given the inexistence of loose parts. Damage to the canvas cannot be repaired, so the damaged and/or lost part or parts will be replaced.

The charge for damage or loss of the hood or its components can amount to up to €2,500 according to the “Damage and loss rate” published on the rent4experience.com website.

Jeep Wrangler soft top vehicles are delivered without the side and rear windows. If requested, an extra deposit (regardless of the contracted insurance) of €300 must be deposited as a guarantee for damage or loss.

 

  1. The client will receive from the company the corresponding instructions to fold or unfold the hood. In case of doubt, once the rental has started, you should go to the nearest office of the company, where you will receive help to carry out the operation.

 

GENERAL CONDITIONS OF INSURANCE

 

  1. TYPES OF INSURANCE

The company offers the renter three types of insurance “Basic”, “Medium” and “Premium”. The “Basic” insurance is included in the rental price.

 

“BASIC”

It includes occupant insurance, under the conditions stipulated by the insurance company arranged by the company, and a franchise for damage and theft of the rented vehicle.

A deposit of an amount equivalent to the franchise of the contracted group is required.

 

The lessee can increase the coverage of this insurance by contracting any of the following options:

 

“MEDIUM”

Group 1

Group 2

 

Exempts the lessee from paying for damage to the sheet metal, headlights, bumpers, roof (except sunroof).

The amount of the deposit will be €300, in the event that a credit card is provided as a guarantee. If you do not have a credit card, the amount of the deposit will be €600 in cash. (see Annex II Table: Insurance rates and franchises).

The amount of the excess is €0 for the damages exempted in this insurance. The lessee will have to pay the cost of damage caused to tires, rims, hubcaps, windows and locks.

The minimum age to contract this insurance is 23 years.

 

Group 3

Exempts the lessee from paying for damage to the sheet metal, headlights, bumpers, roof (except sunroof).

This insurance limits the deposit to €3,000.

The amount of the excess is €0 for the damages exempted in this insurance. The lessee will have to pay the cost of damage caused to tires, rims, hubcaps, windows and locks.

The minimum age to contract this insurance is 30 years.

 

“PREMIUM”

Group 1

It exempts the lessee from paying the damages mentioned in the optional “Medium” insurance and damages to tires, rims, hubcaps, windows and locks. Roadside assistance is also included in this option.

The amount of the deposit will be €100, in the event that a credit card is provided as a guarantee. If you do not have a credit card, the amount of the deposit will be €300 in cash.

The amount of the excess is €0 for the damages exempted in this insurance.

The minimum age to contract this insurance is 23 years.

 

Group 2

It exempts the lessee from paying the damages mentioned in the optional “Medium” insurance and damages to tires, rims, hubcaps, windows and locks. Roadside assistance is also included in this option.

The amount of the deposit will be €100, in the event that a credit card is provided as a guarantee. If you do not have a credit card, the amount of the deposit will be €1,500 in cash.

The amount of the excess is €0 for the damages exempted in this insurance.

The minimum age to contract this insurance is 23 years.

 

Group 3

It exempts the lessee from paying the damages mentioned in the optional “Medium” insurance and damages to tires, rims, hubcaps, windows and locks. Roadside assistance is also included in this option.

The amount of the deposit will be €1,900, charged to a credit card as a guarantee.

The amount of the excess is €0 for the damages exempted in this insurance.

The minimum age to contract this insurance is 30 years.

 

  1. DAMAGES NOT COVERED BY ANY INSURANCE CONTRACTED
  2. Loss, breakage, dampness, theft of keys or remote controls.
  3. Damage to the underside of the vehicle.
  4. Damage inside the vehicle.
  5. Damage caused by misuse of the clutch.
  6. The recharging of the battery, due to negligence of the client.
  7. Administrative management expenses (Management) derived from the damage or theft of the vehicle.
  8. The expenses of managing fines, derived from the initiation of a traffic sanctioning file during the rental of the vehicle.
  9. The missing elements of the vehicle (for example: antenna, hubcaps, brushes, tray, mats).
  10. The expenses derived from the delivery of double keys, due to: loss of keys, breakage or abandonment of these inside the closed vehicle.
  11. Damage caused to the hoods of convertible vehicles.
  12. Expenses derived from the replacement of punctured wheels in the event that the vehicle has a spare wheel. The cost of replacing a wheel is €50.
  13. INVALIDATION OF THE CONTRACTED INSURANCE

In any case, the insurance will be invalidated when the lessee does not comply with any of the assumptions mentioned in clauses 5.2 and 5.5 of the General Rental Conditions, being the latter responsible for all the damages caused to the vehicle by accident, theft, breakdown, loss or loss of its parts, as well as the days of stoppage of the vehicle.

The limit of the maximum amount of money, Excess, that the lessee will have to pay for the cost of the damage caused to the vehicle will also be annulled.

 

In the event of an accident or theft of the vehicle, the company is not obliged to replace the leased vehicle.

In the event of theft, the contracted insurance coverage will not apply if the lessee does not present the corresponding report within 24 hours and the vehicle keys.

In the event of an accident, the contracted insurance coverage will not apply if the lessee does not present the corresponding accident report.

These General Conditions of Rental and Insurance are valid from the day: 04/01/2022
